TERMS OF USE - LOVED ONES APP

1. GENERAL
These Terms of Use ("Terms") apply to the use of the Loved Ones mobile application ("App"), offered
by:

By downloading, installing, or using the App, you agree to these Terms.

2. DESCRIPTION OF THE APP
Loved Ones is an iOS application that allows you to:
- Scan the memorial card. The name and dates are automatically saved.
- Link surviving relatives to your Loved Ones.
- Add a personal photo and notes.
- Set up one of the widgets on your phone's home screen.
- Receive reminders on every birthday and death anniversary.
- See at a glance how old your Loved One would have been or how many years ago the death
anniversary was.
- Send surviving relatives a message via WhatsApp or call them directly.
- Multilingual, the app can be used in multiple languages.
- 100% private, your data remains stored on your phone or iCloud.

3. SYSTEM REQUIREMENTS
- iOS 17.0 or higher
- iPhone (all models that support iOS 17)
- iCloud account (optional, for synchronization)

4. COSTS
The App is free to download and use. There are no in-app purchases, subscriptions, or hidden costs.

5. YOUR DATA AND PRIVACY
5.1 Data Storage
All data you enter (names, dates, photos, notes, contact information) is stored exclusively:
- Locally on your iPhone
- In your personal iCloud (if you activate iCloud synchronization)
5.2 No External Servers
We do NOT collect, store, or process any of your data on external servers. All data remains under your
control.
5.3 Access to Device Functions
The App requests access to:
- Camera: For scanning memorial cards and gravestones
- Photo Library: To add photos to profiles
- Contacts (optional): To link surviving relatives
- Notifications: For reminders on important dates
- iCloud: For automatic backups (optional)
You can manage these access rights through your iPhone settings.
5.4 Analytics
The App does NOT use analytics, tracking, or other tools to monitor your usage.

6. YOUR RESPONSIBILITIES
6.1 Accurate Information
You are responsible for the accuracy and legality of the information you enter in the App.
6.2 Respectful Use
You agree not to use the App for:
- Illegal purposes
- Posting offensive, discriminatory, or hateful content
- Abuse of the OCR scanning functionality
- Attempts to circumvent the App's security
6.3 Backups
We recommend that you regularly make backups via:
- iCloud synchronization (automatic)
- The export function in the App
We are not liable for data loss.

7. INTELLECTUAL PROPERTY
7.1 Ownership
The App, including design, code, logos, and the "Loved Ones" brand name, is owned by Moment of
goodbye and protected by copyright and other intellectual property rights.
7.2 License
You receive a personal, non-transferable, non-exclusive license to use the App on your iPhone(s) for
private purposes.
7.3 Restrictions
You may not:
- Copy, modify, or distribute the App
- Reverse-engineer or decompile the App
- Use the App for commercial purposes without permission

8. DISCLAIMER AND LIABILITY
8.1 "As Is" Delivery
The App is provided "as is," without any warranty. We do not guarantee that the App:
- Works flawlessly or uninterruptedly
- Meets all your expectations
- Is compatible with future iOS versions
8.2 Limitation of Liability
To the extent permitted by law, we are not liable for:
- Data loss or corruption
- Missed reminders due to technical problems
- Incorrect OCR scan results
- Damage resulting from use of the App
8.3 OCR Functionality
Text recognition (OCR) for memorial cards and gravestones is a tool. Always check scanned data for
accuracy before saving.

9. UPDATES AND SUPPORT
9.1 App Updates
We may update the App with:
- Bug fixes
- New features
- Improvements
Updates are free. We recommend keeping the App up to date.
9.2 Support

We aim to respond within 5 business days.

10. TERMINATION
10.1 By You
You can stop using the App at any time by removing it from your iPhone. Note: locally stored data will
also be deleted.
10.2 By Us
We reserve the right to:
- Remove the App from the App Store
- Discontinue support
- Stop future updates
We will communicate this in advance when possible via the App Store or our website.

11. APPLE APP STORE TERMS
This App is distributed via the Apple App Store. You acknowledge that:
- These Terms are between you and Moment of goodbye, not with Apple
- Apple bears no responsibility for the App
- Apple is not obligated to provide support
- In case of violation of these Terms, Apple has the right to remove the App from your App Store
account
- Apple, as a third-party beneficiary, has the right to enforce these Terms

12. APPLICABLE LAW
12.1 Dutch Law
These Terms are governed by Dutch law.
12.2 Disputes
Disputes arising from these Terms will be submitted to the competent court in the Netherlands (district
of 's-Hertogenbosch).

13. CHANGES
We may update these Terms. In case of significant changes, users will be informed via:
- A notification in the App (if technically possible)
- An update on our website: https://www.momentofgoodbye.nl/lovedones/terms
By continuing to use the App after changes, you accept the new terms.

14. OTHER PROVISIONS
14.1 Entire Agreement
These Terms constitute the entire agreement between you and Moment of goodbye regarding the use
of the App.
14.2 Severability
If a provision is declared invalid, the remaining provisions remain in effect.
14.3 No Waiver of Rights
Failure to enforce a right does not constitute a waiver of that right.
